Patna High Court

Lal Mohan Sharma @ Pranav Kumar AtharvaversusThe State of Bihar

Decided

DISPOSED

Holding

The court directed the petitioner to approach the Deputy Collector Land Reforms, Danapur for redressal and disposed of the writ petition.

Summary

The petitioner, Lal Mohan Sharma, filed a writ petition seeking to quash an order dated 11‑09‑2025 and a subsequent letter dated 16‑09‑2025 that rejected his claim to raiyatee land on the basis of a false revenue report. He also sought a declaration that the land (Survey Plot No. 142, 5.23 acre and Plot No. 139, 2.59 acre) be recorded in his name and that rent receipts be issued in his favour. The court allowed the petitioner to implead the Deputy Collector Land Reforms, Danapur as an additional respondent and directed him to approach that officer for redressal of his grievance. The State counsel argued that the petition, if entertained, should proceed to its logical conclusion. The court, however, ordered that the matter be taken up by the Deputy Collector and disposed of the writ petition.

Issues considered

  • Whether the order dated 11‑09‑2025 and the consequential letter dated 16‑09‑2025 can be quashed on the ground of a false revenue report.
  • Whether the petitioner should be directed to approach the Deputy Collector Land Reforms, Danapur for redressal of his claim.
  • Whether the writ petition should be entertained or dismissed in view of the above.
