Patna High Court

Smt. Kamla Devi and AnrversusThe State Of Bihar and Ors

Decided
Disposal
DISMISSED

Holding

The Court held that the writ petition stands abated where the petitioner is deceased without substitution and is dismissed where the petitioner does not wish to press the petition.

Summary

Petitioners Smt. Kamla Devi (deceased) and Kumari Archana filed a civil writ petition against the State of Bihar and education officials. The petitioners' counsel informed the court that the first petitioner had died and no substitution was forthcoming, and that the second petitioner had no instructions to continue the proceedings. The court examined whether the petition could proceed in light of the death of a petitioner and the lack of desire to pursue the case. It held that a petition cannot continue when the petitioner is dead without substitution, and that a petition not pressed by a petitioner must be dismissed. Consequently, the petition was dismissed as not pressed with respect to petitioner no. 2 and abated with respect to petitioner no. 1.
