Summary
Petitioner Md. Naseem filed a writ petition seeking a certiorari to quash Memo No.853 dated 26‑08‑2015 issued by the Deputy Collector, Land Reforms, Darbhanga, which directed private respondent No.6 to deposit 50% of his offer amount despite the petitioner having already deposited the full bid amount of Rs. 6,93,000 for the Bharwara Bazar/Hat. The petitioner alleged that the respondents were interfering with the settlement in his favour. During the hearing, the petitioners, through counsel Mr. Jagnnath Singh and Mr. Deepak Kumar, requested permission to withdraw the petitions. The Court allowed the withdrawal and dismissed the petitions as withdrawn, also disposing of any interlocutory applications.
Issues considered
- Whether Memo No.853 directing the private respondent to deposit 50% of the offer amount is legally valid and can be quashed.
- Whether the respondents have the authority to interfere with the settlement of the Bharwara Bazar/Hat in favour of the petitioner.
