Holding
The writ application is disposed of by granting the petitioner liberty to file representation before the Director and directing the Director to decide the matter within six months, with a reasoned order.
Summary
The petitioner, Dhananjay Kumar, sought a writ directing the Director of Primary Education, Bihar to grant him the trained pay scale and arrears of salary from the date of his B.Ed. appointment, relying on memo No.1790 dated 16.10.2024 and a prior case (C.W.J.C. No. 9416 of 2019). The petitioner also requested a mandamus for the Director to entertain his representation and decide within a fixed period. The respondents raised no objection to the limited relief sought. The Court, with the parties' consent, disposed of the writ by granting the petitioner liberty to file a representation before the Director within one month and directing the Director to dispose of the representation within six months, with a reasoned order and, if relief is warranted, to implement it within two weeks. No substantive determination on the entitlement to the trained pay scale or arrears was made.
Issues considered
- Whether the petitioner is entitled to the trained pay scale and salary arrears as per memo No.1790 and the precedent C.W.J.C. No. 9416 of 2019.
- Whether the Court can issue a mandamus directing the Director of Primary Education to entertain the petitioner's representation and decide within a stipulated time.
