Patna High Court

Rambhadra PandeyversusThe State of Bihar

Decided
Disposal
DISMISS FOR NON-PROSECUTION

Holding

The writ petition is dismissed for non‑prosecution.

Summary

Rambhadra Pandey filed a writ petition in the Patna High Court seeking to quash an order dated 25-04-2019 passed by the Public Grievance Redressal Officer, Nalanda, and to cancel a Jamabandi issued by the Circle Officer, Chandi, alleging that the order was passed without a hearing and that the land record was created without verification. The petition also requested disposal of representations filed on 13-03-2019 and any other reliefs. No counsel appeared on behalf of the petitioner, while the State was represented by Mr. Dhurjati Kr. Prasad, GP‑14. The State counsel informed the Court that a title suit between the parties was already pending before a competent civil court and that adjournments had been sought. In view of the pendency of the title suit and the petitioner’s failure to prosecute the writ petition, the Court dismissed the petition for non‑prosecution. The order was pronounced by Hon’ble Mr. Justice Rajiv Roy.

Issues considered

  • What is the appropriate course of action when a writ petition is filed while a substantive title suit is pending between the same parties?
  • Whether an order passed by the Public Grievance Redressal Officer without a hearing can be quashed by a writ petition.
