Disposal
CONSIGNED

Holding

The petition was dismissed, and the 2021 revision proceeding was not quashed.

Summary

The petitioner, Suresh Kumar Rai, filed a writ petition seeking the quashing of Revision Case No. 05 of 2021, arguing that the dispute had already been finally decided in three revision cases (Nos. 1393‑1395 of 1988) favoring his predecessors. He also requested that the Director, Consolidation, Bihar dispose of the pending revision within three months. The court issued a notice to private respondents (Nos. 4‑6) but the order was peremptory and the defects were not remedied. Consequently, the petition was dismissed on 7 October 2025, leaving the 2021 revision proceeding intact. The court did not entertain the alternative relief for expedited disposal.

Issues considered

  • Whether the 2021 revision proceeding can be quashed on the ground that the matter was already finally adjudicated in earlier revision cases
  • Whether the authority is obligated to dispose of the pending revision within a stipulated time frame

Subjects

  • revision
  • quashing
