The Court held that the Municipal Commissioner must pay the amount due to the petitioner within four weeks.
Summary
The petitioner, Lakhraj Radhika India Private Limited, through its proprietor Alok Kumar, filed a civil writ petition before the Patna High Court seeking payment of amounts due from the Municipal Corporation of Chapra. The respondents, including the State of Bihar and several municipal officials, submitted that they were ready to pay the dues if granted a reasonable time. The petitioner contended that the corporation was already liable to pay the amount without further delay. The Court considered the submissions and found no substantive dispute over liability, focusing on the procedural aspect of granting time for payment. Consequently, the Court directed Respondent No.4, the Municipal Commissioner, to pay the amount due within four weeks of receipt of the order. With this direction, the writ petition was disposed of.
