DISPOSED

Holding

The court disposed of the writ, granting the petitioner liberty to file a fresh representation and directing the university to decide it within a specified period.

Summary

Sadre Alam, a B.Sc (Hons) Botany graduate, filed a writ petition seeking an order directing Baba Saheb Bhimrao Ambedkar Bihar University to publish his final result for the 2021-24 academic year. He offered to file a fresh representation before the Controller of Examination and requested the court to fix a time‑frame for disposal of that representation. The university had no objection to the limited prayer. The High Court, with the parties' consent, disposed of the writ by granting the petitioner liberty to file the representation within one month and directing the Controller to decide it within three months, with a reasoned order to be issued within four weeks of the final decision. The court emphasized that any favorable order must be a speaking order and that all pending interlocutory applications stand disposed.

Issues considered

  • What relief, if any, can be granted by a writ court to compel a university to publish examination results?
  • Whether the court can prescribe a time‑frame for the university's internal representation and disposal thereof.

  • writ jurisdiction
  • mandamus

                      3. In the present writ application, the petitioner has

prayed for grant of following relief-

“i. For issuance of an appropriate writ,
                                  order or direction commanding the

the petitioner (B.Sc) Hons (Botany) for
                                  academic year 2021-2024.

one year time for future reference.”

                    4. After advancing some argument, the learned

counsel for the petitioner submits that for seeking the

aforesaid reliefs, the petitioner is prepared to file a fresh

representation before the Controller of Examination, Baba

Saheb Bhimrao Ambedkar, Bihar University, Muzaffarpur.

He prays that an appropriate direction be issued to the

Controller of Examination, Baba Saheb Bhimrao Ambedkar,

Bihar University, Muzaffarpur (respondent no.3) to dispose

of the representation within a fixed time-frame, after giving

                          5. To the aforesaid prayer made by the learned

counsel for the petitioner, the learned counsel appearing for the

respondent-University does not have any objection.

                        6. Considering the limited nature of prayer made by

the learned counsel for the petitioner, this writ application is

disposed of, granting liberty to the petitioner to file a fresh

representation before the Controller of Examination, Baba

(respondent no.3) within one month from today. If such a

an opportunity of hearing to the petitioner.

                      7. Needless to emphasize that the final order,

which shall be passed by respondent no.3, should be a

reasoned and speaking order, and in case the petitioner is

found entitled to the reliefs, which the petitioner would be

claiming through the representation, then the same should

be extended to the petitioner within a period of four weeks

from the date of passing of the final order by respondent no.3.

                        8. With the aforesaid observation/direction and
