Summary

Petitioners, who are shebaits of deities and religious institutions in Kharsar village, filed a writ petition challenging an order dated 25-07-2016 passed in land‑ceiling case No. 22/73‑74/7/93‑94 that directed restoration of possession of the deities to the petitioners and ordered the ejection of certain respondents. They sought the setting aside of that order, protection of the properties during the pendency of the ceiling proceedings, and restoration of possession. The respondents, including the State of Bihar and various officials, were served notice on 18-08-2025, which they failed to comply with, leading to a peremptory order on 13-10-2025. The High Court noted the non‑compliance and consigned the matter for further consideration. No final decision on the merits was recorded in the excerpt.

Issues considered

  • What is the appropriate remedy for petitioners seeking restoration of possession of religious deities under a land‑ceiling proceeding?
