Since the motorcycle had been released in favour of the petitioner, the court disposed of the writ petition.

Summary

Prince Kumar filed a civil writ petition in the Patna High Court challenging the seizure of his Hero Splendor Plus motorcycle by the State of Bihar authorities. The petition named the Department of Excise, the District Magistrate, the Superintendent of Police and the SHO as respondents. The petitioner’s counsel submitted that the motorcycle, bearing registration No. BR29AP7876, had already been released in his favour. The court examined whether any further relief was required given the release of the vehicle. Finding that the petitioner’s grievance had been fully redressed, the court saw no basis to continue the petition. Consequently, the writ petition was disposed of on the terms of the release.
