Sudhir KumarversusThe State of Bihar

Decided

DISPOSED

Holding

The court held that a writ cannot be entertained where an efficacious alternative remedy under the Bihar Public Land Encroachment Act, 1956 exists.

Summary

Sudhir Kumar filed a public‑interest writ petition seeking a court order for the removal of illegal encroachments on two parcels of government land (a pond and a bhinda) in Village Maheya, Vaishali. The encroachments were allegedly made by local individuals named as respondents 9‑12, who had constructed residential structures on the land. The Court examined whether it could grant the writ despite the existence of an alternative statutory remedy. It held that because the petitioner has an efficacious remedy under the Bihar Public Land Encroachment Act, 1956, the writ petition could not be entertained. Consequently, the petition was disposed, with liberty granted to the petitioner to approach the appropriate authority under the Act for redress. The decision underscores the principle that courts should not supplant specialized statutory mechanisms when they are available.

Issues considered

  • Can a writ petition for removal of illegal encroachment be entertained when an alternative remedy under the Bihar Public Land Encroachment Act, 1956 is available?
  • Does the existence of an alternative statutory remedy preclude the court from granting relief in a public‑interest litigation?
