The writ petition is dismissed, with liberty granted to the petitioners to pursue the appeal before the Divisional Commissioner.

Summary

The Union of India and other defence officials filed a writ petition challenging an order dated 25‑01‑2024 issued by the Muzaffarpur District Magistrate that allowed local residents to use land claimed as defence property and directed the removal of a fence and barbed wire. The petitioners sought certiorari, mandamus and other reliefs to restore their possession of the land acquired by the army in 1923. The Court noted that an appeal against the impugned order is pending before the Divisional Commissioner, Tirhut Division. Since the petitioners have an alternative statutory remedy, the Court declined to interfere with the order. Accordingly, the writ petition was disposed of, granting the petitioners liberty to pursue the appeal before the Divisional Commissioner.

Issues considered

  • What is the legal status of the land claimed as defence property acquired in 1923?
  • Whether the District Magistrate's order allowing local residents to use the land and directing removal of the fence is ultra vires?
  • Whether the petitioners are entitled to a writ of certiorari or mandamus in the present circumstances?

Subjects

  • defence land
  • land acquisition
  • writ of certiorari
  • mandamus
