Holding

The Court granted the petitioner liberty to approach the appropriate authority and disposed of the petition without commenting on its merits.

Summary

The petitioner, Sachit Prasad, filed a writ petition seeking a direction to the respondents to restore an earlier order of the Circle Officer that had corrected the online Jamabandi of his disputed land after verification. He alleged that the correction order was later reviewed and cancelled by the same officer without any notice to him. The petitioner requested liberty to approach the appropriate authority or court for redressal of this grievance. The Court, after hearing counsel, granted the petitioner liberty to approach the appropriate forum and disposed of the writ petition without addressing the merits of the case. No substantive order on the restoration of the Jamabandi correction was made.

Issues considered

  • Whether the petitioner is entitled to a direction to restore the earlier corrected Jamabandi order.
  • Whether the cancellation of the correction order without notice violates principles of natural justice.
  • Whether the petitioner can be granted liberty to approach a higher authority for redressal.
