Holding
The Court held that the petitioner must first file a representation before the Engineer‑in‑Chief, and the respondent must decide the representation within two months, providing a reasoned order if the relief is denied.
Summary
The petitioner, Basant Kumar Tiwari, filed a writ petition seeking the payment of third ACP/MACP salary, arrears, pension adjustments, and exemption from a computer proficiency test, alleging entitlement from 1 July 2019. The respondents, comprising the State of Bihar and officials of the Rural Works Department, opposed the reliefs. The Patna High Court directed the petitioner to first file a representation before the Engineer‑in‑Chief of the Rural Works Department within four weeks. The Court further ordered that the concerned respondent must dispose of the representation within two months and, if the relief is denied, provide a reasoned order. The writ petition was consequently disposed with these procedural directions.
Issues considered
- What entitlement, if any, does the petitioner have to the upgraded third ACP/MACP salary and related benefits from 1 July 2019?
- Whether the petitioner is entitled to exemption from the computer proficiency test for the post.
- Whether the administrative authority must entertain a representation and decide it within a stipulated time before denying relief.
