Patna High Court

Sarwar FaizversusThe Union of India

Decided
Disposal
DISMISS FOR NON-PROSECUTION

Holding

The petition is dismissed for non‑prosecution.

Summary

The petitioner sought a writ of mandamus directing the Union of India, the Ministry of Road Transport and Highways, the State of Bihar and related officials to refrain from widening National Highway 82 in a manner that would disturb a Kabristan (graveyard) situated on the proposed alignment, and to follow the procedures under the National Highways Act, 1956. The petition also invoked constitutional provisions protecting religious interests. No counsel appeared on behalf of the petitioner, and the petitioner failed to appear at the hearing on 20-01-2026 (and earlier on 04-04-2025). The Court observed that the petitioner had lost interest in the case. Consequently, the writ petition was dismissed for non‑prosecution.

Issues considered

  • Whether the respondents are required to refrain from widening NH 82 that would affect the Kabristan as per the petitioner's claim.
  • Whether the land acquisition and road widening complied with the National Highways Act, 1956 and constitutional protections under Articles 13, 23, 25, and 26.
  • Whether the petitioner's failure to appear warrants dismissal of the writ petition for non‑prosecution.
