The settlement agreement being voluntary and bona‑fide, the writ petition is disposed and the arrest warrant is quashed.

Summary

Gen X Infra Homes Pvt Ltd filed a writ petition challenging an arrest warrant issued by the Real Estate Regulatory Authority (RERA) of Bihar. Both the petitioner and Respondent No. 4 (Krishna Singh) jointly submitted that they had reached an amicable settlement on 10 January 2026, documented in a compromise agreement, wherein the respondent confirmed receipt of vacant possession of the flats and parking area. The court examined the voluntary and bona‑fide nature of the settlement and found no coercion or fraud. Consequently, the court quashed the arrest warrant and disposed of the writ petition in accordance with the settlement terms. The matter was thus concluded without further adjudication on the merits of the original dispute.

Issues considered

  • Whether a writ petition can be dismissed on the basis of a settlement agreement between the parties
  • Whether the arrest warrant issued by the RERA Authority remains valid after the parties have settled the dispute
