Gagan KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The petition is dismissed as infructuous because an out‑of‑court settlement was reached.

Summary

The petitioner, Gagan Kumar, filed a civil writ petition in the Patna High Court against the State of Bihar, several government officials and officers of Punjab National Bank. The petition sought relief (specific relief not detailed) but during proceedings the petitioner’s counsel informed the Court that an out‑of‑court settlement had been reached between the parties. The Court examined the submission and held that, with the settlement, there was no longer any live dispute for the Court to adjudicate. Consequently, the writ petition was declared infructuous and dismissed. The Bank gave an undertaking to the Court, which was recorded on the record.
