Holding

The writ petition is disposed, granting the petitioner liberty to raise her grievance before the Bihar Mahadalit Vikas Mission within 60 days.

Summary

Pinki Kumari filed a writ petition seeking a mandamus directing the State and its officials to issue her appointment letter as Vikash Mitra in Gram Panchayat Krishnanagar and to dispose of her representation. The petitioner also sought liberty to raise her grievance before the Bihar Mahadalit Vikas Mission (BMVM). The court noted that the interlocutory application filed by the petitioner was not pressed and dismissed it. The petitioner’s counsel requested that the writ petition be disposed with liberty to approach BMVM, a request unopposed by the BMVM. The court agreed, disposing the writ petition and granting the petitioner a 60‑day period to raise her grievance before the BMVM. No substantive merits of the appointment claim were decided.

Issues considered

  • What relief, if any, is appropriate for the petitioner regarding the issuance of an appointment letter and disposal of her representation?
  • Whether the writ petition can be disposed with liberty to the petitioner to approach the Bihar Mahadalit Vikas Mission within a stipulated period.
