Holding
The Court dismissed the writ relief and directed the petitioner to file a revision before the Divisional Commissioner within one month, condoning the delay.
Summary
Nagina Khatoon filed a writ petition challenging Memo No‑522 dated 09‑03‑2019 that selected a private respondent to operate a PDS shop under the Bihar Targeted Public Distribution System (Control) Order, 2016, and also objected to the selection in a representation dated 02‑08‑2019. The respondents relied on Sections 32(v) and 32(vi) of the 2016 Order, which provide for stay of an order pending appeal and for filing a revision before the Divisional Commissioner if an appeal is not disposed of within sixty days. The petitioner argued that the limitation period for filing a revision had expired and sought a direction under Section 5 of the Limitation Act to entertain the revision. The Court observed that the petitioner has an alternative remedy of filing a revision and directed him to file the revision within one month, condoning the delay, and ordered the Divisional Commissioner to dispose of the revision within three months. The writ petition was consequently disposed of.
Issues considered
- Whether the Memo selecting the private respondent to run a PDS shop can be set aside by a writ.
- Whether the petitioner can be permitted to file a revision before the Divisional Commissioner despite the lapse of the statutory limitation period.
