DISMISSED

Holding

The petition does not qualify as a Public Interest Litigation and is dismissed.

Summary

The petitioner, Binod Kumar Singh, filed a writ petition seeking a court order directing various state authorities to widen the Navratan Kunwar Ghat in Chamuchak village and to allocate funds for the work. He requested a time‑bound action plan, cost estimate, and procurement details, invoking public interest. The Court examined the petition and determined that there was no material to treat the matter as a Public Interest Litigation. Consequently, the Court found no basis to intervene in the administrative decision of the respondents. The petition was therefore dismissed in its entirety. The judgment underscores that not all infrastructure grievances qualify as PILs warranting judicial intervention.

Issues considered

  • Whether the writ petition filed by the petitioner can be treated as a Public Interest Litigation.
  • Whether the Court can direct the respondents to undertake the widening of Navratan Kunwar Ghat and allocate funds for the same.
