Patna High Court

Sushma KumariversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The petition was disposed of because the CBI had already taken over the investigation, rendering the court's intervention unnecessary.

Summary

The petition filed by Sushma Kumari sought court‑monitored investigation into the suspicious death of a NEET aspirant and a series of structural reforms for girls’ hostels in Bihar, including mandatory registration, safety standards, a regulatory authority and SOPs for police and hospitals. The respondents were the State of Bihar and various officials. The Advocate General informed the court that the CBI had already taken over the investigation. The bench held that since the CBI was handling the matter, the petition could not be entertained further. Consequently, the writ petition was disposed of without granting any of the requested directions. The decision underscores the principle that courts will not duplicate investigations already undertaken by competent agencies.

Issues considered

  • Whether the High Court can direct a CBI investigation into a suspicious death under a writ petition
  • Whether the court can issue mandatory regulatory and safety directives for girls’ hostels through a writ
  • Whether the creation of a State Hostel Regulatory Authority and related SOPs can be mandated by the court

Subjects

  • CBI investigation
  • girls' hostels
  • mandatory licensing
  • public interest litigation
  • writ jurisdiction
  • state regulatory authority
  • hostel safety
  • NEET aspirant death
