The Court declined to grant mandamus and directed the petitioners to file a fresh representation, with the Commission to decide it within six weeks.
Summary
A group of candidates (the petitioners) filed a writ petition seeking a mandamus directing the Bihar Technical Service Commission to award them experience marks in the recruitment of Civil Junior Engineer, contending that their earlier representations (Annexures P/6 & P/7) remained pending. They also asked that the Commission consider these representations in the upcoming recruitment. The Court observed that the representations were still pending before the Secretary of the Commission and that it had not been called upon to decide the merits. Accordingly, the Court ordered the petitioners to file a fresh representation within two weeks and directed the Secretary to decide it within six weeks, without granting any mandamus. The writ application was therefore disposed without adjudicating the substantive claim.
Issues considered
- Whether a writ of mandamus can be issued to compel the Bihar Technical Service Commission to grant experience marks to the petitioners.
- Whether the Court can entertain the petition without a fresh representation from the petitioners.
- Whether the petitioners are entitled to the benefit of experience marks pending administrative decision.
