Patna High Court

Raman RanjanversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The writ petition is disposed, directing the petitioner to approach the appropriate respondents for relief.

Summary

The petitioner, Raman Ranjan, filed a writ petition seeking a mandamus directing the State authorities to correct Khata No. 417 for Plot 986, protect his possession of the disputed land, and cancel a deed of exchange dated 05‑04‑1988. He alleged that the land record incorrectly listed the State of Bihar as owner and that the executants were not complying with the deed. The court heard arguments and noted that the petitioner’s counsel intended to file fresh petitions before the Additional Collector and Circle Officer. The State counsel warned that such petitions would be taken to their logical conclusion. The court granted the petitioner liberty to approach the concerned authorities within four weeks and disposed of the writ petition without granting the reliefs, directing the petitioner to seek redress through the appropriate administrative channels.

Issues considered

  • Whether a writ of mandamus can be issued to compel correction of a Khata (land record) in favour of the petitioner
  • Whether the court can direct the cancellation of a deed of exchange dated 05‑04‑1988
  • Whether the petitioner must first approach the administrative authorities (Additional Collector, Circle Officer) before seeking judicial relief

Subjects

  • land record correction
  • Khata
  • writ of mandamus
  • deed of exchange
  • possession
  • civil writ jurisdiction
  • Bihar land law
