An administrative order that blacklists a party without specifying reasons and without granting a hearing violates natural justice and must be set aside.

Summary

Universal Ideal Sewa Samiti filed a writ petition challenging a letter dated 27‑11‑2025 that blacklisted it for two years under the Bihar Skill Development Mission. The petitioner argued that the show‑cause notice was vague, contained no specific charges, and denied a chance to be heard. The High Court examined whether the notice complied with the principles of natural justice. Finding the notice and the subsequent order to be unspecific and violative of the right to a fair hearing, the Court set aside the blacklisting order. The matter was remitted to the authority to issue a fresh, detailed show‑cause notice and to afford a personal hearing before any final decision.

Issues considered

  • Whether the show‑cause notice issued to the petitioner satisfied the requirements of natural justice.
  • Whether an administrative order that blacklists a party without stating specific reasons and without a hearing is valid.
  • Whether a writ of certiorari is the appropriate remedy to quash the blacklisting order.

                        3. Upon bare perusal of the show-cause, it appears

that the notice is vague. No specific reasons are indicated, nor is

any particular charge alleged against the petitioner.

Subsequently, a final order was passed vide Annexure-P/13

dated 27.11.2025. It is noted that neither the show-cause nor the

order under challenge specifies the reasons for blacklisting the

          petitioner.

                        4. In view of above, order dated 27.11.2025 is set

aside. The matter is remitted back to the authority concerned,

who shall issue a fresh show-cause notice granting the petitioner

liberty to file a reply thereto and, if necessary, afford a personal

hearing to the petitioner before passing a final order in

          accordance with law.
