The Court directed the respondents to accept the petitioners' application for an electrical connection and to consider it strictly in accordance with law, effectively granting the writ of mandamus.
Summary
A group of five petitioners filed a writ petition seeking a mandamus directing the electricity department officials (respondents No. 6 and 7) to accept their application for an electrical connection to premises at Rajiv Nagar Police Station and to allow them to deposit the required amount. The respondents argued that the petition could be disposed of by directing the officials to accept the application along with the requisite amount. The High Court held that the officials must accept the application and consider it strictly in accordance with law, and also directed respondent No. 5 to process the application within four weeks of receipt of the order. Consequently, the writ petition was disposed of with these specific directions. The order emphasizes the duty of public utility officials to act on lawful applications for service connections.
Issues considered
- Whether the electricity department officials are legally obligated to accept the petitioners' application for an electrical connection and consider it per law.
- Whether a writ of mandamus can be issued to compel the officials to accept the application and allow payment of the requisite amount.
