Ram Bali ChoudharyversusThe State of Bihar

The Court declined to grant the writ of mandamus and directed the petitioner to file a representation before the DGP, setting timelines for decision and payment.

Summary

Ram Bali Choudhary filed a writ petition seeking a mandamus directing the State of Bihar and police officials to backdate his first MACP promotion from 04‑01‑2011 to 09‑08‑1999, relying on a Supreme Court and Patna High Court full‑bench judgment that employees are entitled to ACP/MACP benefits without a departmental exam. He also requested benefits of a second ACP from 02‑01‑2000 and a third MACP from 01‑01‑2009. The petitioner alleged that his earlier representations received no response. The Court, after hearing counsel, declined to issue the mandamus and instead ordered the petitioner to file a fresh representation before the Director General of Police within two weeks, directing the respondent to decide the matter within six weeks and to make any payment within two months, with a reasoned order if the representation is rejected. The writ application was therefore disposed of without granting the relief sought.

Issues considered

  • The petitioner’s entitlement to have his first MACP date backdated based on the cited Apex Court and Patna High Court judgments.
  • Whether a writ of mandamus can be issued directing the respondents to grant ACP/MACP benefits without a departmental examination.
  • The appropriate procedural remedy for the petitioner’s grievance.
