Holding

The Court allowed the withdrawal of the writ petition and directed the petitioner to file a representation before the insurer within four weeks.

Summary

The petitioner, Suryadev Kumar, sought the High Court's permission to withdraw his writ petition and instead file a fresh representation before Go Digit General Insurance Ltd. (Respondent No. 3) regarding his grievance. The Court granted the request, ordering that the present writ petition be dismissed as withdrawn and allowing the petitioner a four‑week period to make his representation to the insurer. The Court directed that the insurer consider the representation strictly according to law and communicate any decision to the petitioner. If dissatisfied with the insurer's decision, the petitioner may approach the Insurance Ombudsman (Respondent No. 1). The Court expressly stated that it made no findings on the merits of the underlying dispute. Consequently, the writ petition stands disposed of as withdrawn.
