DISPOSED

Holding

The Court disposed of the writ, granting the petitioners liberty to file representations before the Director and directing a hearing and reasoned order, without granting immediate mandamus.

Summary

A group of teachers filed a writ petition seeking the grant of the trained pay scale and payment of salary arrears, relying on memo No.1790 dated 16‑10‑2024 and a prior judgment in CWJC No. 9416/2019. They also requested a mandamus directing the Director of Primary Education to implement the pay scale. The State of Bihar raised no objection. The Court, with the parties' consent, disposed of the writ by granting the petitioners liberty to file detailed representations before the Director, accompanied by the relevant judgment, within four weeks, and directed the Director to hear them, pass a reasoned order within six weeks, and, if relief is warranted, implement it within three months. No immediate mandamus was issued; the application was dismissed after these directions.

Issues considered

  • The petitioners' entitlement to the trained pay scale and arrears of salary under memo No.1790 and the precedent CWJC No. 9416/2019.
  • Whether the Court can issue a mandamus directing the Director of Primary Education to grant the pay scale.
  • The appropriate procedural steps for the petitioners to obtain relief.

                      4. After advancing some argument, learned counsel

for the petitioners submits that the case of the petitioners is

similar to the case of one Satyendra Kumar Ojha, petitioner of

CWJC No. 9416 of 2019 in which an order was passed on

04.03.2024 (Annexure-P/3) relegating the petitioner of the said

case to file a representation before the Director, Primary

Education, Department of Human Resource Development, Bihar

along with a copy of the judgment passed in L.P.A. No. 1699 of

2013 and other relevant documents and the Director, Primary

Education, Department of Human Resource Development, Bihar

was further directed to pass a reasoned and speaking order after

giving personal hearing to the petitioner of the said case.

Learned counsel for the petitioners submits that similar liberty

may be granted to the petitioners of this case also.

                      5. To the aforesaid prayer being made by learned

counsel for the petitioners, learned counsel appearing for
Patna High Court CWJC No.2599 of 2026(2) dt.18-02-2026

respondent-State does not have any objection.

                      6. Considering the limited nature of prayer being

made by learned counsel for the petitioners, this writ application

is disposed of granting liberty to the petitioners to file a detailed

representation before the Director, Primary Education

Department Govt. of Bihar, Patna (respondent no. 3) along with

a copy of the judgment passed in L.P.A. No. 1699 of 2013 and

other relevant documents within a period of four weeks from

today. The representation must be separately filed by all the

petitioners. If such representations are filed within the stipulated

time then the Director, Primary Education Department Govt. of

Bihar, Patna (respondent no. 3) is directed to dispose of the

same within a further period of six weeks from the date of filing

of the representations, after giving an opportunity of personal

hearing to the petitioners. Needless to emphasize that the final

order which shall be passed by the Director, Primary Education

Department Govt. of Bihar, Patna (respondent no. 3) should be a

reasoned and speaking order. It is further considered appropriate

to observe that if the the petitioners are found entitled to the

relief which they would be claiming through the representations,

the same should be extended to the petitioners within a further

period of three months from the date of passing of the final

                    order.

                                7. With the aforesaid observation/direction and liberty

granted, this writ application is disposed of. All pending

interlocutory application(s), if any, shall also be deemed to have

                    been disposed of.
