Budhiram Singh @ Sudhiram SinghversusThe State Of Bihar and Ors

Decided
Disposal
DISMISS FOR NON-PROSECUTION

Holding

The writ petition is dismissed for want of prosecution.

Summary

Budhiram Singh filed a writ petition in the Patna High Court seeking a writ of certiorari to quash an order dated 10‑Oct‑2014 passed by the Bihar Land Tribunal in BLT Case No. 679 of 2013, which had allowed an application on behalf of respondent 5 challenging earlier orders of the Director of Consolidation. No counsel appeared for the petitioner, though the State was present. The Court noted that the petition had not been prosecuted. Consequently, the petition was dismissed for want of prosecution, without addressing the merits of the challenge to the Tribunal’s order.

Issues considered

  • Whether the order of the Bihar Land Tribunal dated 10‑Oct‑2014 can be quashed by a writ of certiorari.
  • Whether the petitioner's failure to prosecute the writ petition warrants dismissal.

  • writ of certiorari
