The court held that the revenue officer must dispose of the petition within 30 days from the order, failing which contempt proceedings may be initiated.
Summary
The petitioner, Pramod Kumar Gupta, filed a writ petition seeking a court order directing the Bihar revenue authorities to enter his name in the jamabandi and related digital records for his land, and to reconstruct the jamabandi to reflect his ownership, after the Circle Officer failed to dispose of his application within the prescribed 30‑day period. The petitioner argued that despite submitting his application on 8 September 2025, the Circle Officer had not acted, prompting the writ jurisdiction. The State counsel contended that the officer should take immediate steps to dispose of the petition. The court observed that the revenue officer’s inaction violated the statutory time limit and warned that failure to dispose within 30 days would invite contempt proceedings. Accordingly, the writ petition was disposed with an order directing the Circle Officer to dispose of the petition within 30 days from the date of the order, and the State counsel was directed to inform the officer immediately.
Issues considered
- Whether the revenue officer’s failure to dispose of the petition within the statutory 30‑day period warrants a writ directing disposal and a warning of contempt.

3. The matter relates to a piece of land under Mauza-
Kajiapur/Balipur, Circle Patna Sadar. Learned counsel for the
petitioner submits that the application was submitted before the
Circle Officer, Patna Sadar, Patna on 8th September, 2025 but
despite the thirty days period that has been allowed to the
revenue officers to dispose of the petition, till date the said said
officer, the Circle Officer, Patna Sadar, Patna (respondent no.4)
has not disposed it of.

4. Learned State counsel submits that immediate steps
shall be taken and the Circle Officer, Sadar, Patna shall be
disposing of the petition of the petitioner.
5. It is unfortunate that despite the State Government
restricting the time limit for a Revenue Officer to dispose of any
petition, the concerned Revenue Official sat over the file of the
petitioner forcing him to invoke the writ jurisdiction. He has to
take steps and dispose of the petition of the petitioner within a
period of thirty days from today failing which the petitioner
shall be free to take steps for filing an appropriate petition for
initiation of contempt proceeding against him/her.
6. The writ petition is disposed of with the aforesaid
observation and the order has been passed in the presence of
learned State counsel who undertakes to inform the Circle
Officer, Sadar, Patna today itself.
