The petitioner must file a fresh representation with the travel allowance bill, after which the respondent shall adjudicate the claim.

Summary

The petitioner, Suman Saurabh, filed a writ petition seeking payment of travel allowance, arrears, and interest from the State of Bihar and related health officials. The respondents, particularly the Civil Surgeon‑cum‑Chief Medical Officer, contended that the petitioner had not submitted any bill for the travel allowance. Both parties were heard, and the court directed the petitioner to file a fresh representation, including the travel allowance bill, within 30 days before the Civil Surgeon‑cum‑Chief Medical Officer. The respondent was then ordered to decide the claim within 60 days of receipt. Accordingly, the writ petition was disposed.

Issues considered

  • Whether the petitioner must submit a bill/representation for travel allowance before the court can grant relief.
