Holding

The Court held that a writ petition may be withdrawn at the petitioner's request, subject to the respondent's consent, and liberty may be granted to approach the appropriate authority.

Summary

Md. Meraj filed a civil writ petition in the Patna High Court challenging actions of the State of Bihar and several education officials. The petitioner later sought to withdraw the writ application, requesting liberty to approach the appropriate authority for redress. The respondent State raised no objection to the withdrawal. The Court considered whether a writ petition can be withdrawn at the petitioner's request and whether liberty can be granted for alternative redress. Finding no impediment, the Court allowed the withdrawal and granted the petitioner liberty to approach the appropriate authority. The writ application was consequently disposed of as withdrawn.
