- DISPOSED
Holding
The Court held that, in the absence of specific allegations and after the petitioner had an alternative remedy, the writ petition could not be entertained.
Summary
Petitioner Chandan Kumar filed a writ petition seeking a mandamus directing various state authorities to act against alleged irregularities by the Gobadda PACS Chairman in the 2025-26 paddy procurement. He claimed to have made a representation to the Registrar of Bihar Cooperative Societies on 16-12-2025, which allegedly received no action. The Court observed that the petitioner had an alternative remedy before the authority to which the representation was made and that the petition lacked specific details of the alleged irregularities, which are essential for enquiry and evidence collection. Consequently, the Court declined to entertain the writ petition. The petition was therefore disposed of.
Issues considered
- Whether a writ of mandamus can be issued to compel action on alleged irregularities in paddy procurement without specific particulars.
- Whether the petitioner must first exhaust the remedy of filing a representation with the Registrar before approaching the court.
