The petitioners must first approach the Service Grievances Redressal Officer as mandated by the Bihar Government Servant Grievances Redressal Rules, 2019, and the writ petition is disposed.
Summary
A group of twenty‑two Upper Division Clerks (UDCs) filed a writ petition seeking a direction that they be paid their first Assistant Commissioner of Police (A.C.P.) salary in the 5000‑8000 scale (grade pay 4200) instead of the 2800 grade pay granted to them by the District Magistrate, citing Finance Department resolutions and notifications. The petitioners argued that other UDCs were already receiving the higher scale. The State contended that the Bihar Government Servant Grievances Redressal Rules, 2019 require the petitioners to first exhaust the grievance redressal mechanism before approaching the court. The Court held that the petitioners must approach the Service Grievances Redressal Officer within the prescribed time‑frame and dismissed the writ petition. Consequently, the petition was disposed, directing the petitioners to use the statutory remedy.
