Balwant Kumar SamaiyarversusThe State of Bihar

DISPOSED

Holding

The Court declined to issue a mandamus and instead directed the petitioner to file a fresh representation and the Department to decide it within a stipulated time.

Summary

The petitioner, Balwant Kumar Samaiyar, filed a writ petition seeking a mandamus directing the State of Bihar and the Secretary of the Scheduled Caste/Scheduled Tribe Welfare Department to grant him the benefits of the 1st and 2nd MACP after completing 10 and 20 years of service, along with all consequential monetary benefits. He alleged that despite having submitted a representation to the Department, no response or benefit was provided. The Court observed that the petitioner must file a fresh representation before the Department within four weeks. The Department was ordered to decide the representation within two months and, if the benefits are payable, to disburse them within two months of the order. In case of refusal, a reasoned order must be communicated. The writ application was disposed with these directions, without granting the writ of mandamus.

Issues considered

  • What is the appropriate remedy when an administrative authority fails to act on a representation seeking statutory service benefits?
  • Whether a writ of mandamus can be issued directing the grant of 1st and 2nd MACP benefits without a fresh representation by the petitioner.
