The court held that the Additional Collector, Rohtas must pass the final order in the mutation revision case by 30 June 2026, and accordingly disposed of the writ petition.

Summary

The petitioner, Satyendra Kumar Singh, filed a writ petition seeking direction to dispose of Mutation Revision Case No. 170/2023 pending before the Additional Collector, Rohtas, alleging undue delay of over two and a half years and influence of respondent No.12. He also prayed for quashing of a proceeding under BNSS, 2023 (Case No. 144 of 2025) initiated on forged documents, and for action against officials alleged to have accepted bribes for mutating land records. The court noted the annexure showing the case was filed on 11‑Oct‑2023 and last adjourned on 3‑Oct‑2025, confirming the inordinate delay. The State counsel agreed that the final order should be passed soon. Accordingly, the court directed the Additional Collector to conclude the mutation revision proceeding and pass the final order by 30‑June‑2026, and disposed of the writ petition.

Issues considered

  • Whether the delay in disposing Mutation Revision Case No. 170/2023 violates the petitioner’s right to speedy justice

Patna High Court CWJC No.3395 of 2026(2) dt.16-03-2026
                                                       3/3

                                 4. The Mutation Revision Case No. 170 of 2023 is

presently pending before the Additional Collector, Rohtas at

Sasaram. The prayer is that the Case no. (170/2023-24) itself

reflects that the matter is pending for two and half years without

                     any progress.

                                 5. This Court has taken note of the concerned Annexure

which shows that the Mutation Revision Case No. 170 of 2023-24

was preferred on 11.10.2023 and last adjourned on 03.10.2025.

                                 6. It is high time that the same is taken to its logical

                     conclusion.

                                 7. Learned State Counsel submits that the concerned

official shall be passing the final order at an earliest.

                                 8. Accepting the words of the learned State Counsel and

directing the respondent no. 5, the Additional Collector, Rohtas at

Sasaram to conclude the proceeding and in any case, dispose it of

by 30.06.2026, the writ petition is disposed of.
