Holding

The Court held that the petitioners may file fresh representations before the Examination Controller, who must dispose of them within the stipulated time, without granting immediate mandamus for result revision.

Summary

A group of petitioners, who appeared for the Secondary Teacher Eligibility Test (STET‑2025), filed a writ petition seeking a mandamus directing the Bihar School Examination Board (BSEB) and the State Education Department to follow departmental guidelines and publish a revised result, alleging that the answer key was incorrect. The petitioners also requested the release of the final answer key and were prepared to file fresh representations before the Examination Controller. The State and BSEB raised no objection to the limited relief sought. The Court, with the parties’ consent, disposed of the writ at this stage, granting the petitioners liberty to file fresh representations within ten days and directing the Examination Controller to decide those representations within eight weeks, and to issue a reasoned order within four weeks if relief is warranted. No substantive order on the merits of the result revision was made; the matter was left to the administrative process. The writ application was therefore disposed of with directions for further representation.

Issues considered

  • Whether the petitioners are entitled to a mandamus directing the BSEB to publish a revised STET‑2025 result.
  • Whether the Court can order the petitioners to file fresh representations and prescribe time‑limits for the Examination Controller’s decision.
  • Whether the Board must adhere to the education department’s guidelines and the specified advertisement in determining the result.

and its examination department, to release
the revised/final answer key from which the

                      4. After advancing some argument, learned counsel

Examination Board, Patna to dispose of the representations filed

counsel for the petitioners, learned counsel appearing for

respondent-State and learned counsel for the Bihar School

Examination Board do not have any objection.

                      6. Considering the limited nature of prayer being

made by learned counsel for the petitioners, this writ application

is disposed of granting liberty to the petitioners to file separate

fresh representations before the Examination Controller (STET-

2025), Bihar School Examination Board, Patna (respondent no.

          5) within ten days from today. If such representations are filed

by the petitioners within the stipulated time then the

          Examination Controller (STET-2025), Bihar School

Examination Board, Patna (respondent no. 5) is directed to

dispose of the same within a period of eight weeks from the date

of filing of the representations. Needless to emphasize that the

final order which shall be passed by the Examination Controller

(STET-2025), Bihar School Examination Board, Patna

(respondent no. 5) should be a reasoned and speaking order. It is

further made clear that in case, the petitioners are found entitled

to the relief which they would be claiming through the

representations, the same should be extended to the petitioners

within a further period of four weeks from the date of passing of

          the final order.

                                7. With the aforesaid observation/direction and liberty

granted, this writ application is disposed of. All pending
