DISPOSED

Holding

The petitioner must first exhaust the grievance redressal process under the Bihar Government Servant Grievances Redressal Rules, 2019 before filing a writ petition.

Summary

The petitioner, a retired correspondence clerk, filed a writ petition seeking the grant of Assured Career Progression (ACP) / Modified ACP benefits that he claims were denied after his retirement in 2014. The State argued that the petitioner must first exhaust the grievance mechanism provided under the Bihar Government Servant Grievances Redressal Rules, 2019, which contain a specific forum for such complaints. The Court examined whether the petitioner could directly approach the High Court for relief or was required to follow the statutory grievance procedure. It held that the petitioner is obliged to file a complaint under the 2019 Rules before seeking judicial intervention. Accordingly, the Court directed the petitioner to pursue the grievance before the designated authority and disposed of the writ petition.
