Holding

The Court held that the petitioner may be permitted to file a fresh writ petition challenging the rejection of her representation.

Summary

Dr. Ruby Kumari, a medical faculty member, filed a writ petition seeking seniority, promotion and related benefits as an Assistant Professor, contending that the Health Department’s memo dated 14‑04‑2020 should be applied to her. She also requested a writ of mandamus directing the respondents to consider her seniority from the date of the notification and to treat her service length on par with other appointees under the same advertisement. While the petition was pending, a representation filed by her was rejected by the Principal Secretary, Health Department, prompting her counsel to seek liberty to challenge that rejection. The State had no objection to granting such liberty. The Court examined the procedural posture and noted that no private respondent’s rights were affected by the rejection order. Accordingly, the Court disposed of the writ petition, granting the petitioner liberty to file a fresh writ petition against the rejection order and any other relief.

Issues considered

  • Whether the petitioner is entitled to seniority, consequential benefits and promotion as per the memo dated 14‑04‑2020 issued by the Health Department

the time of filing of the present writ petition, representation was

pending before respondent No.3, the Principal Secretary, Health
