Holding

The court declined to grant mandamus and directed the petitioner to file a fresh representation before the Municipal Commissioner, after which the matter will be decided in accordance with law.

Summary

Manish Kumar filed a writ petition seeking a mandamus directing the Municipal Commissioner of Bettiah to reduce the settlement amount he was required to deposit, alleging that three of the ten toilets under the settlement were non‑functional. The petitioner argued that the non‑repair of these toilets warranted a reduction in the amount payable. The court examined the nature of the relief sought and held that it could not grant mandamus without a fresh representation by the petitioner. Accordingly, the court disposed of the writ application, directing the petitioner to file a new representation within four weeks and the respondent to decide on it within two months. The writ petition was thus dismissed, with procedural directions issued for a fresh filing.
