Holding

The Court did not decide the substantive entitlement but directed the respondent authority to consider the petitioner’s representation and pass a reasoned order within 90 days.

Summary

The petitioner, a Central Reserve Police Force (CRPF) employee with 24 years of service, filed a writ petition seeking a mandamus directing the respondents to grant him Accrued/Assured Career Progression (ACP) benefits and to pass a reasoned order on his representation dated 08‑12‑2023. He alleged that despite completing the requisite service, the ACP benefit had not been paid and that his representation remained unanswered. The Union of India contended that the petitioner had made suppressions in his pleadings. The Court, without adjudicating the merits of the entitlement claim, ordered the Commandant of the 190th Battalion to decide on the petitioner’s representation within 90 days of receipt of the order. No substantive determination on the ACP claim was made, and the petition was disposed with a directive for administrative action.

Issues considered

  • Whether the petitioner is entitled to Accrued/Assured Career Progression benefits under the applicable departmental guidelines.
  • Whether the failure to pass a reasoned order on the petitioner’s representation violates principles of natural justice.
  • Whether a writ of mandamus is the appropriate remedy in the present circumstances.
