The court directed the Block Teacher Employment/Appointment Committee to dispose of the pending representation within six months, after hearing the petitioner, and to grant the promotion within three months if the petitioner is found entitled.
Summary
Vishal Ranjan, a headmaster, filed a writ petition seeking a mandamus directing the Block Teacher Employment/Appointment Committee (BTEAC) of Chanpatia to consider his representation dated 01‑04‑2025 and grant him promotion under Rule‑5(3) of the Bihar Panchayat Elementary School Services Rules, 2020. He alleged that the committee had not acted on his representation, which remained pending. The State of Bihar, represented by education officials, raised no objection to the limited relief sought. The Patna High Court, with the consent of both parties, disposed of the petition by ordering the BTEAC to dispose of the pending representation within six months, after giving the petitioner a hearing, and to issue a reasoned order. The court further directed that if the petitioner is found entitled to promotion, the promotion should be effected within three months of the final order. No substantive determination on the merits of the promotion claim was made; the order merely set a time‑bound procedure.
Issues considered
- Whether the petitioner is entitled to a writ of mandamus directing the Block Teacher Employment/Appointment Committee to consider his pending representation for promotion under Rule‑5(3) of the Bihar Panchayat Elementary School Services Rules, 2020.
- Whether the court can prescribe a specific time‑frame for the administrative authority to dispose of the representation and grant the promotion if entitlement is established.
Subjects
- mandamus

- education service
- Bihar Panchayat Elementary School Services Rules
- administrative law
