Holding

The Court held that the petitioner is entitled to seek release of the seized truck by filing an application under Rule 12A(2) of the Rules, 2023, and the competent authority must decide the application within two weeks.

Summary

The petitioner, Manoj Kumar Yadav, filed a writ petition seeking the release of a Tata truck seized under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 for alleged involvement in the recovery of illicit foreign liquor. The High Court granted the petitioner liberty to file an application under Rule 12A(2) of the Bihar Prohibition and Excise (Amendment) Rules, 2023 for release of the vehicle upon payment of a penalty. The Court directed that the application be filed within two weeks and that the competent authority decide the matter on merits and issue a reasoned order within another two weeks. No substantive determination on the merits of the seizure was made. The writ petition was consequently disposed subject to the stipulated procedural steps.
