Patna High Court

Akhilesh KumarversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The High Court held that the petitioner must first avail himself of the remedy under Rule 12A of the Bihar Prohibition and Excise Rules, 2021, and therefore the writ cannot be entertained.

Summary

The petitioner, Akhilesh Kumar, sought a writ directing the State of Bihar and its officials to release his seized Honda motorcycle, which was allegedly found with illegal wine. He also requested release upon payment of a penalty. The Court observed that the petitioner had not invoked the statutory remedy provided under Rule 12A of the Bihar Prohibition and Excise Rules, 2021, which requires an application to the competent authority for release of seized property. The Court therefore declined to entertain the writ and directed the petitioner to file the appropriate application before the Collector or authorized officer within 30 days. It further instructed that the competent authority consider the quantity of seized liquor and any prior involvement of the petitioner before fixing any penalty. The writ application was dismissed, with liberty granted to the petitioner to pursue the statutory remedy.

Issues considered

  • Whether the petitioner can approach the High Court directly for release of a seized vehicle without first invoking the remedy under Rule 12A of the Bihar Prohibition and Excise Rules, 2021.
  • Whether the High Court has jurisdiction to grant relief in a matter that is expressly covered by a statutory procedure.

                      4. On perusal of the writ application, it appears that
