The Court declined to issue a writ directing appointment and instead directed the petitioner to file a fresh representation before the District Education Officer, who must decide it within a specified time.
Summary
The petitioner, Amit Kumar, sought a writ of mandamus directing the State of Bihar and its education officials to appoint him as an assistant teacher on a compassionate basis, replacing his block teacher position, and to grant him all attendant benefits retroactively. He offered to file a fresh representation before the District Education Officer (DEO) of Vaishali and requested that the DEO dispose of it within a fixed period, with a hearing. The State had no objection to this approach. The Court, with the parties' consent, disposed of the writ application at this stage, granting the petitioner liberty to file the representation within one month and directing the DEO to decide it within three months, issuing a reasoned order. If the DEO finds the petitioner entitled to the relief, the appointment and benefits must be effected within three months of that order. All pending interlocutory applications were also deemed disposed.
Issues considered
- Whether the petitioner is entitled to a compassionate appointment as an assistant teacher in place of a block teacher.
- Whether a writ of mandamus can be issued directing the appointment and grant of benefits.

7. Needless to emphasize that the final order which
shall be passed by the District Education Officer, Vaishali

within a further period of three months from the date of passing
of the final order by the District Education Officer, Vaishali.
8. With the aforesaid observation/direction and liberty
granted, this writ application is disposed of. All pending
interlocutory application(s), if any, shall also be deemed to have
