Amar KumarversusThe State of Bihar

DISPOSED

Holding

The court declined to quash the appointment and instead ordered the authority to dispose of the petitioner’s representation within four weeks.

Summary

Amar Kumar filed a writ petition challenging the office order dated 21/08/2025 that appointed Sanjit Kumar as Vikas Mitra, seeking to quash the order, the merit list, and to obtain his own appointment. He also requested that the authorities consider his case for service benefits. The court observed that the petitioner had earlier filed a representation on 15/10/2025 before the Bihar Dalit Vikas Mission. In the interest of justice, the court directed the concerned authority to dispose of that representation by a reasoned order within four weeks. No substantive interference with the selection committee’s decision was made, and the writ petition was disposed on the terms of the direction.

Issues considered

  • Whether the office order appointing Sanjit Kumar as Vikas Mitra can be quashed.
  • Whether the merit list prepared by the Executive Officer can be set aside.
  • Whether the petitioner is entitled to appointment to the post of Vikas Mitra.
  • Whether the authorities must consider the petitioner’s representation filed on 15/10/2025.
