DISMISSED

Holding

The writ petition is dismissed as it is barred by delay and latches.

Summary

Nityanand Tiwari, a retired engineer aged 80, filed a writ petition seeking regular increments payable from April 1994 and reclassification of his service as a gazetted Assistant Engineer from June 28, 2002 instead of September 1, 2002. The petition was filed in 2026, more than two decades after the alleged entitlement arose. The High Court examined whether the petition could be entertained despite the extensive delay. The Court held that the petition was barred by limitation and the doctrine of latches, rendering it inadmissible. Consequently, the writ application was dismissed.

Issues considered

  • Whether the writ petition is maintainable despite the delay of over two decades.
  • Whether the petitioner is entitled to regular increments from 1994 and reclassification as a gazetted Assistant Engineer from 2002.
