The court ordered the concerned authority to process the compassionate applications for a PDS licence expeditiously, within eight weeks of receipt of the order.
Summary
The petitioner, Vijay Kumar Jha, applied for a compassionate appointment of a PDS licence after his father's death in 2021, filing representations on 30‑04‑2022 and 31‑05‑2025. The authorities failed to process the applications. Both parties consented to a limited intervention by the court. The High Court, without examining the merits, directed the Sub‑Divisional Officer (Respondent No.3) to consider the applications and issue a decision within eight weeks, communicating any clarification to the petitioner. The order also required the authority to give the petitioner an opportunity to produce any requested documents. The writ petition was thereafter disposed.
Issues considered
