The Circle Officer, Mashrakh, is duty‑bound to examine the matter and pass an appropriate order correcting the Jamabandi in accordance with law.

Summary

The petitioner, Sikandar Ray, filed a writ petition seeking correction of Jamabandi No. 74 for a land parcel in Saran district, alleging that the register incorrectly records the buyer as Jangi Raut instead of Bhawan Raut as per Sale Deed No. 3945 dated 11-05-1921. The petitioner relied on a direction from the Deputy Commissioner of Land Reforms (DCLR) and a subsequent notice issued to the Circle Officer, Mashrakh, but no corrective action was taken. The State of Bihar argued that once the notice was issued, the matter should be concluded in accordance with law. The Court examined the procedural history and directed that the Circle Officer, Mashrakh, must examine the case, hear the parties, and pass an appropriate order to correct the land record. The Court issued a notice to the Circle Officer and disposed of the writ petition.
