DISPOSED

Holding

The writ petition was disposed of without any substantive consideration, effectively rejecting the reliefs sought.

Summary

Munna Kumar Sah filed a writ petition challenging an order dated 15 December 2025 issued by the Deputy Chief Land Revenue Officer (DCLR) that directed the petitioner to present documents for certain land parcels. He also sought protection of his life and property from private respondent No. 7, who allegedly obstructed the construction of a boundary wall with the help of antisocial elements, and requested a restraining order against further interference. The petitioner claimed that the land had been illegally demarcated and possession was being handed over to the private respondent in violation of his rights. The State of Bihar and several district officials were impleaded as respondents. The High Court, after hearing the parties, disposed of the writ petition without commenting on the merits or granting any of the reliefs sought. Consequently, the petition was dismissed and no further orders were made.

Issues considered

  • Whether the order dated 15‑12‑2025 passed by the DCLR can be quashed.
  • Whether the respondents, including private respondent No. 7, are liable to protect the petitioner’s life and property and be restrained from interfering with his possession.
  • Whether the petitioner is entitled to any additional reliefs under the writ jurisdiction.

Subjects

  • writ jurisdiction
  • land dispute
  • quashing order
  • protection of life and property
  • illegal demarcation
  • possession
